The General Power of Attorney in Costa Rican referred to as “Poder Generalisimo” is the broadest power of attorney that can be conferred in Costa Rica. Unless the document specifies otherwise this Power of Attorney confers upon the agent to whom it is granted broad powers to buy, sell, mortgage, lien or encumber the property of the principal. This type of Power of Attorney requires that it be granted before a Costa Rican Notary Public or before a Costa Rican Consular officer if granted abroad. It then must be registered in the National Registry before it becomes effective. To revoke it the grantor must again appear before a Notary Public to revoke it and record the revocation.
The law which regulates this General Power of Attorney is Article 1253 of the Civil Code.
