Are Prenuptial Agreements legal in Costa Rica?
The Family Code in Costa Rica, recognizes the validity of Premarital Agreements which allocate the distribution of present and future assets between spouses by way of a contractual agreement. The Premarital Agreement must be signed in the Notary Public protocol book and registered in the Public Registry, in order to be valid. (Article 37 of the Family Code) The content of the premarital agreement is a contract between the spouses and the terms agreed to in that contract must be legally valid in order to be enforced.
